Court considers death sentence for Ohio neo-Nazi (AP)

WASHINGTON – The Supreme Court appears inclined to reinstate a death sentence for a neo-Nazi convicted of murdering three men in Ohio more than a quarter century ago.

Ohio's attorney general told justices during oral arguments that Frank Spisak had a fair trial and deserves death.

Spisak's attorney says his client had an ineffective lawyer in 1983 and that jurors received improper sentencing instructions.

Most of the justices were skeptical of the defense lawyer's arguments.

It's the second time the case is before the high court. The justices reinstated Spisak's death sentence two years ago in a decision that scolded federal appeals courts for second-guessing trial judges in murder cases.

But the federal appeals court in Cincinnati reached the same conclusion it did the first time.
